How to Synthesize Diethyl(phenylacetyl)malonate?​

Diethyl phenylmalonate is obtained from Ethyl phenylacetate (CAS 101-97-3), which isn't included in controlled precursor list of International Narcotics Control Board (INCB). Diethyl phenylmalonate is used for Phenobarbital direct synthesis.​

Diethyl phenylmalonate is used in the synthesis of phenobarbital but Diethyl phenylmalonate is not the same as Diethyl(phenylacetyl)malonate. Any reason why it is mentioned here?

Most likely has not been classified yet, but check any EU list yourself. Also who cares if it is illegal, when they find this shit at customs and if they do a lab analysis. The lab analysis will most likely be done by chemists and they will know what this is for by seeing the similarities to previous precursors (my guess is that this is what is going to happen). Hence you deny you ordered it and you simply "collected the package because of a notification."

Yeah they list it under as

Diethyl 2-(2-phenylacetyl)propanedioate.​

Again this changes nothing for end husers, we just get it from china and nothing would have been different. Cops would still have broken in the door if they had found it, but it was not technically illegal, yet.​

it depends on country then, its listed under EU 273/2004, so its illegal to posses without permission.
penalities depends on country. at least it gonna be confiscated if got caught with it.
